Terms of Sale and Puppy Contract

 

All of our puppies come with a contract of sale which must be signed on collection. The contract is to reassure and protect both parties, making sure that we have done everything possible to rear a happy, healthy puppy and we will give a lifetime of support to owners as well as ensuring that new owners understand the needs of the animal they are taking on and will provide a loving, stable home for life.

 

Viewings of puppies starts from 4 weeks of age and we will only release a puppy when we believe he or she is ready (at a  minimum of 8 weeks old), only selling to homes that we believe suitable for the individual breed and character of the puppy.

Once a puppy has been selected it is only secured by a £100 non refundable deposit.

 

As well as being given all the TLC possible whilst in our care, for our peace of mind (as well as new owners), all puppies are vet checked before they leave us. In the event something is found when a pup is given its pre collection vet check any details will be disclosed in advance as well as being detailed on the contract. We will never knowingly sell a sick animal, should something be found to be wrong with a puppy it will stay with us until better. If it is a condition the puppy is going to have for life we would discuss this with new owners before collection and if new owners feel unable to take on the pup we would either return the deposit, offer another puppy from the litter if available or from a future litter. This is the only reason a deposit would be returned other than us cancelling the sale (which we reserve the right to do at anytime prior to collection if the pup or new home is found to be unsuitable).

 

We also reserve the right to put breeding endorsements on all our puppies. Although our puppies are bred to be family pets first and foremost we are not against families who wish to breed responsibly so are willing to discuss removing endorsements upon maturity. Whilst we pride ourselves in breeding from happy, healthy adults, we cannot sell our puppies with any guarantee of adult physical features or being ideal for breeding  or showing when matured.

 

Below is a copy of our contract. We are happy to discuss our contract with owners prior to sale and a copy is retained by both parties.

SECTION FOUR:     HEALTH AND WELFARE:

 

I, the Breeder take pride and care in the breeding, rearing and welfare of my dogs and the above detailed dog is sold to the Purchaser (as detailed in section 3) in good faith that it is good health and has no known conditions, except, if appropriate, those detailed in section 5.

 

The Breeder has had the Dog inspected by a practising veterinary surgeon prior to collection and details of the inspection have been passed onto the Purchaser.

 

The Purchaser is advised to take the Dog to their veterinarian within 5 days of purchase for a general health check and advice on vaccinations, worming and flea treatment.

 

The Breeder guarantees to disclose all known details of health, breeding and care to the Purchaser and to be available, whenever reasonably possible to give a lifetime of support to the Purchaser.

 

SECTION FIVE:     PURCHASERS RIGHT TO RETURN THE DOG IN THE CASE OF DEFECT:

 

The Purchaser has 5 days after collection to have the Dog examined by a practising veterinary surgeon and shall have the right during a period of not exceeding 5 days after such examination to return the Dog because of a defect (other than described below) on production of a written report from said veterinary surgeon, at which time the Purchaser will be refunded the full purchase price. This guarantee does not include injury or disease incurred after sale when the Dog is no longer in the Breeder’s care. Nor does it include diarrhoea as although every effort is made to ensure the pup leaves without diarrhoea, it is a common reaction to the stresses of changing home and environment, in particular when dietary changes are suddenly made (not recommended as stated in the ‘Puppy Information Sheet’ provided on collection). Though the Breeder will always be available to assist or have the Dog back, the Purchaser has read the Breeders information sheet on vaccines and is also aware this health and full refund guarantee is voided if the ‘L4’ vaccine is given to the Dog.

Should it become necessary, the Purchasers should be aware that the return of the Dog can be very difficult, especially emotional and, having drawn the attention of the Purchaser to this, the Breeder cannot be held responsible for any distress caused by the return of the Dog.

 

SECTION SIX:  POTENTIAL OF THE DOG AND ENDORSEMENTS:

 

All Dogs bred by the Breeder are for the primary purpose of family pets so although any description of the dog is given in good faith at the time of sale, the Breeder gives no guarantee to the Dog’s potential as to its show, working or breeding potential upon maturity. Although the Breeder will advise the Purchaser what the expected adult appearance will be, it is understood by the Purchaser that the Breeder cannot give guarantees to adult physical features such as coat colour (particularly in Cairn Terriers), facial markings, tail carriage, ear position, teeth placement, nor testicular descent in males.

 

Under Kennel Club regulations, there are two endorsements that may be placed on a pedigree, registered dogs’ record, by the registered owner of a dog, whilst the dog in question is still in their possession. A breeder, therefore is entitled to place two endorsements on a puppy’s record with the Kennel Club. One restricts the registration of any future offspring (progeny) and the other prevents the issue of an export pedigree. 

 

Only the person that places the endorsements can lift them by writing a signed instruction to this effect to the Kennel Club.

 

If the Breeder feels a Dog bred by them is not eligible for breeding for any reason but is not KC registered (for example a Jack Russell Terrier), breeding restrictions may still apply. All details of the reason will be explained and mutually agreed to prior to sale) and the Purchaser signs to declare the Dog will not be bred from and will be neutered.

 

The Breeder has placed the following endorsement(s) on the Dog’s pedigree/ places the following restriction of breeding:

  • NOT ELIGIBLE FOR EXPORT PEDIGREE

  • PROGENY NOT ELIGIBLE FOR REGISTRATION       

 

The Breeder reserves the right to leave endorsements in place if they feel it appropriate. However, the Breeder will normally lift placed endorsements after the following conditions have been met:

 

  • The Dog is a minimum of 2 years old before mating.

  • The Dog has been examined by a practising Veterinary surgeon and has been given a clean bill of health with breeding of the Dog in mind.

  • The Dog is first and foremost a family pet and all aspects of breeding, rearing and homing of puppies has been fully considered.

  • The following breed relevant health screens have been performed: DNA TEST FOR PLL, LOA, SCA & DM (JACK RUSSELLS - IF  NOT HEREDITARY CLEAR). SECTION SEVEN: PROVISIONS OF SALE:

 

The Breeder guarantees the Dog leaves their care in good mental and physical condition. Whilst in the care of the Breeder, the Breeder is liable for any expenses incurred in the care of the Dog. Once the Dog’s ownership has been signed over to the Purchaser on collection and completion of sale, any costs, routine or otherwise are at the Purchasers discretion and expense.

 

If any signs of disease are found following the Purchaser having their vet examine the Dog, other than diarrhoea caused by change of diet, change in environment or travel stress, etc, the Purchaser must contact the Breeder immediately.

 

The Purchaser understands the breed (cross or pedigree) they are undertaking and its individual needs in terms of care as well as potential health issues that may occur, despite the Breeders efforts to avoid these in their breeding programme.

 

The Purchaser and their family is expected to properly socialise, train, exercise and care for the Dog in a loving manner at all times and make sure anyone temporarily caring for the Dog shall do the same.

 

The Purchaser agrees that the Breeder may repossess the Dog immediately upon evidence of neglect, endangerment and/or abuse at no expense to the Breeder.

 

The Purchaser certifies the Dog is being purchased as a family pet for themselves and not a third party and under no circumstances will the Dog ever be sold, leased or given away to a pet shop, research lab, shelter or similar facility.

 

The Purchaser agrees that if, at any stage in the Dog’s life, the Purchaser needs to rehome the Dog, the Breeder will be the first to be informed and the Purchaser will, if the Breeder requests, return the Dog to the Breeder. The Breeder will offer every reasonable assistance to find a new home. Even if the Purchaser chooses to find a new suitable home for the Dog themselves, the Breeder will be informed and given details of any new owner.

 

Should the Dog be returned to the Breeder for any reason, at any age, the Breeder will do so free of charge however a refund (full or partial) or rehoming fee is dependent on the individual case and at the Breeders discretion.
